1. Introduction 

The Ministry of Planning (MOP) of the Kingdom of Cambodia owns and operates the IDPoor Web system and App. You may access and use this Web system/App if you agree to be contractually bound by the terms set out here. If you do not agree to be contractually bound by these terms, please do not access or use the IDPoor Web system and App. 

MOP runs three distinct online systems with regards to the IDPoor mechanism. The IDPoor Web system provides information on the IDPoor mechanism. The IDPoor Web system provides access to the IDPoor Management Information System (MIS), with various types of user accounts. Finally, the IDPoor Public App allows data subjects of the IDPoor MIS to view information related to their entries as well as to file objections and suggestions.

If you choose to log in to the IDPoor Web system/App, you are using your IDPoor account. By using your IDPoor account you are accepting the below explained IDPoor account terms and conditions, IDPoor account privacy policy and IDPoor account cookies policy. These will apply while you are using services within your IDPoor account. 

If you use the IDPoor Web system/App on behalf of someone else: 

(a) these terms apply to your use of the Web system or App; 
(b) you are responsible for compliance with these terms. 

2. Changes to terms 

MOP might make changes to the IDPoor Web system and App, including these terms. You will be contractually bound by the updated or amended terms from the first time that you use the IDPoor Web system and App after we publish the changes on it. 

3. Usage and intellectual property rights 

You have permission to use IDPoor Web system and App content for the sole purposes described, and on the terms detailed, in these terms and conditions. IDPoor data is to be primarily used for the provision of social services. IDPoor data may also be used for non-commercial research purposes as well. Any commercial use is strictly prohibited and you need written permission from the Ministry of Planning before you may use IDPoor data in any other way. 

The Ministry of Planning of the Kingdom of Cambodia own or have the right to use all intellectual property rights in the contents of the IDPoor Web system and App or used for the provision of the IDPoor Web system and App (“IDPoor Web system and App Content”). This includes rights in copyright, patents, database rights, trademarks and other intellectual property rights. 

The following must not be used without MOP’s or the IDPoor Department’s prior consent: 

  • any logos, visuals, image rights, trademarks, trade names and design styles (except where these are integral to a document or data set) of the IDPoor Web system, or any predecessor or linked body, as well as of any partner or contributor; 
  •  any other intellectual property rights, including but not limited to patents, design rights and trademarks; 
  •  personal data (which will include but not be limited to images, videos and audio with identifiable people in them); 
  • information owned by third parties which we are not authorised to licence on to you. This includes everything itemised on our content not covered by our standard terms and conditions page, although we cannot guarantee that this list includes all information owned by third parties. If in doubt, contact us using the details below. 

You must not use IDPoor Web system and App Content for or in association with i) any purpose; or ii) a site or service; which is illegal, derogatory or otherwise objectionable or that brings the IDPoor into disrepute.  

If you provide any paid-for service to your customers or users access to the IDPoor Web system and App Content may be included within the standard purchase and set-up costs but no specific charge may be levied on any customers or users for access to any IDPoor Web system and App content. 

We reserve the right to alter, adapt, edit, modify or restrict the availability of IDPoor Web system and App Content for use on third-party sites at any time. 

4. Third-party web systems 

We do not monitor the content of third-party web systems or third-party Applications. Any link provided on the IDPoor Web system and App is solely for your convenience. We do not accept any responsibility for any third-party web system or third-party Applications. Where we provide links to third-party web systems or Applications, that does not imply any association with or recommendation for those web systems.  

5. Privacy 

When you register for an account on the IDPoor Web system and App, you need to provide personal data and/or to verify your identity. All information you provide must be true, accurate and complete. It is your responsibility to inform us if anything changes with your personal data.  

Our Data Protection Policy (https://idpoor.gov.kh/en/data-protection-policy/) describes how MOP handles the information you provide to MOP when you use these Services. You understand that through our use of the Services you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the storage, processing and use by IDPoor and its affiliates. 

6. Confidentiality 

The IDPoor Mechanism, established in 2006 within the Ministry of Planning, is part of the Government of the Kingdom of Cambodia’s ongoing efforts to reduce poverty and support socioeconomic development throughout the country. The mechanism provides regularly updated information on poor and vulnerable households to a large number of Government and non-governmental agencies to help them target services and assistance to the poorest and most vulnerable persons.  

As a consequence, the IDPoor database contains personal and sensitive information of poor and vulnerable households in Cambodia. By agreeing to these Terms of Use, you acknowledge that the data obtained by logging into your account is completely confidential and shall not be disclosed to anybody else. Any disclosure in violation shall be deemed a breach of this Agreement. 

7. Attacks, unauthorised access and other violations 

You must not try to gain unauthorised access to the IDPoor Web system, our services, the servers on which they’re stored, or any server, computer or database connected to them. You must not attack the IDPoor Web system or services hosted on it in any way, (this includes denial-of-service attacks). We’ll report any attacks or attempts to gain unauthorised access to the site or service to the relevant law enforcement authorities and shall share information about you with them. 

You must not use the IDPoor Web system: 

(a) to transmit any false, misleading, fraudulent, defamatory, offensive or illegal communications; 
(b) in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users; 
(c) in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these terms of use, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, such as viruses or harmful data. 

8. Remedies 

To the extent that we are practically able to do so, we may terminate your access to all or any part of app.idpoor.gov.kh and services at any time without notice if you breach any of the terms. 

To restrict processing, delete data or to revoke consent, please send an email to: [email protected]. This will clear any personal information you have saved.   

9. General 

If any of these terms are determined to be illegal, invalid or otherwise unenforceable then the remaining terms shall remain in full force and effect. 

Your use of the IDPoor Web system and these terms, together with any service specific additional terms, shall be governed by and interpreted in accordance with the laws of Cambodia, and you agree to the exclusive jurisdiction of the courts of Cambodia in respect of any disputes that may arise in relation to the IDPoor Web system.
